Annotatsiya

The article analyzes the principles governing the activities of internal affairs bodies in proceedings concerning administrative offenses. It argues that the current system of principles established in the Code of Administrative Responsibility is largely declarative and does not sufficiently define specific procedural guarantees. The author proposes distinguishing between the substantive legal principles of administrative liability and the procedural principles of administrative proceedings. Based on a comparative legal analysis, the article substantiates the need to establish separate provisions on legality, the presumption of innocence, proportionality, personal inviolability, the right to qualified legal assistance, and the priority of preventing administrative offenses.
