This article examines the constitutional right to life as a fundamental and inalienable human right. It explores its legal nature, normative content as reflected in international instruments and domestic legislation, the moment of its inception, permissible limitations, and the principles governing its protection. Within a comparative legal framework, the article considers the views of legal scholars from diverse legal traditions, including German, American, British, Israeli, and Canadian scholarship. Particular attention is given to controversies concerning the admissibility of capital punishment, the temporal commencement of the right to life, and the recognition of a right to die. The article proposes the concept of a "culture of the right to life" as a new theoretical instrument and puts forward recommendations for improving international legal regulation.
