Annotatsiya

The article treats the principle that “no one shall be a judge in their own cause” not merely as a procedural maxim but as a criterion for assessing the quality of the institutional design of the public administration system. Drawing on an analysis of the 2017–2026 decentralization reforms in public administration, it demonstrates that the rules governing the transfer of powers and financial resources to the local level are formulated by the very bodies expected to relinquish those powers and resources. The body responsible for allocating budgetary resources also determines the procedure for their allocation. Moreover, when disputes over powers arise between different levels of government, there is no independent mechanism for resolving them outside the parties to the dispute themselves. The author proposes removing each of these decisions from the control of the interested body. Powers not expressly assigned by law to the central or regional level should devolve to the district level. Budget transfers should be allocated according to a fixed formula. The results of decentralization pilot projects should be evaluated by an independent body. Disputes over powers should be adjudicated by the courts.
