This article examines the application of the WTO Agreement on Subsidies and Countervailing Measures (SCM Agreement) to governmental support with environmentally beneficial or harmful effects in the green transition. Based on doctrinal legal analysis of the SCM Agreement and WTO dispute settlement jurisprudence, supplemented by comparison with other WTO subsidy regimes, it identifies a dual coverage asymmetry in the applicability of SCM rules. It establishes that beneficial environmental effects do not themselves exclude SCM disciplines where the relevant legal conditions are met, while harmful environmental effects cannot independently establish financial contribution, benefit or specificity. The analysis further shows that differences in fiscal, technological and institutional capacity may produce unequal effective policy space and may also be reproduced through reform. The article proposes a development-sensitive reform model combining a conditional safe harbor, continued disciplines on export-contingent subsidies and local-content requirements, enhanced transparency, proportionate evidentiary requirements and targeted technical assistance.
