The Role of Joint (International) Investigation Teams in International Cooperation in Criminal Matters

The article provides a comprehensive analysis of joint investigation teams in cross-border criminal proceedings, focusing on their legal nature, grounds for establishment, and procedural limits. It distinguishes a joint investigation team from the traditional request-based model of mutual legal assistance and argues that such teams do not diminish state sovereignty, since they operate by consent, within a predefined mandate, and under the law of the state where a specific investigative measure is carried out. The research examines the United Nations Convention against Transnational Organized Crime, the United Nations Convention against Corruption, European Union and Council of Europe instruments, as well as selected French and Dutch approaches. It proposes a set of admissibility criteria for evidence collected within a joint investigation team, including lawful origin, competent authority, compliance with lex loci, respect for defence rights, integrity of the chain of custody for digital evidence, and restrictions on the subsequent use of information. The article identifies a regulatory gap in the Criminal Procedure Code of the Republic of Uzbekistan and proposes a new Article 594¹, together with a model inter-agency agreement governing the establishment and operation of joint investigation teams.
