The article analyzes the substance of the institution of extradition for the purpose of criminal prosecution or enforcement of a final judgment, as well as its international and national legal foundations. It examines the role of the Constitution of the Republic of Uzbekistan, Articles 599–609 of the Criminal Procedure Code, international treaties, and the principle of reciprocity. The study systematically assesses such criteria as safeguarding the rights of the requested person, excluding the risk of torture and the death penalty, the rule of speciality, dual criminality, and judicial review. Particular attention is given to legal issues arising in decision-making concerning persons whose citizenship status has not been established, persons with multiple citizenships, and persons seeking international protection. The article develops proposals aimed at introducing a unified algorithm for examining extradition requests, establishing a standard for verifying state assurances, and clarifying the scope of judicial review.
