Annotatsiya

This theoretical and practical article provides a scholarly analysis of the significance of means of proof and issues related to their evaluation in the resolution of labor disputes. The author emphasizes that the evaluation of evidence is an integral part of the process of proof and finds its external expression in procedural actions regulated by law. Although the evaluation of evidence involves elements of mental activity, it is, by its very nature, a procedural activity, as evidenced by the fact that it is carried out within the legal framework and regulated by the norms of civil procedural legislation. Furthermore, the scholarly and practical classification of labor disputes is regarded as a necessary prerequisite for the court to correctly determine the subject matter of proof. In contrast to a descriptive approach, modern legal doctrine proposes classifying disputes according to a substantive legal criterion, which makes it possible to identify the specific features of the application of law within each category of disputes.
