The article examines the theoretical and legal foundations of the qualification of a socially dangerous act, its comparative legal dimension, and its connection with the limits of criminalisation. The value-based foundation of the object of qualification is examined through the harm principle. Drawing on German Tatbestand dogmatics, Anglo-American offence analysis, and Japanese and Islamic legal traditions, the author proposes a cross-traditional model of qualification. The author substantiates the not-yet-criminalised but actually committed socially dangerous act as the “negative boundary” of qualification and a limiting case of the “qualification gap,” explaining it through the formula K = (L + F + A) / H.
