In the context of the digital transformation of society, data have acquired particular significance as an economic, social, and legal resource. At the same time, neither legal scholarship nor legislation has developed a uniform approach to defining the legal nature of data, which complicates the establishment of a coherent legal framework for their regulation and participation in civil circulation. This article examines the legal nature of data and identifies the limits of their transferability in civil circulation in light of the contemporary challenges posed by the digital economy. Particular attention is paid to the interaction between private-law and public-law principles governing data circulation, as well as to the protection of the rights and legitimate interests of data subjects. The study is based on an analysis of the national legislation of the Republic of Uzbekistan, relevant doctrinal approaches, and current trends in the development of digital technologies. The article concludes that there is a need for a conceptual reassessment of the legal status of data and further improvement of the legal framework governing their circulation.
