Digital Reuse of Journalistic Works by Press Publishers: A Three-Tier Model for Determining the Scope of Exclusive Rights

The shift from a single print format to multi-platform distribution has left a press publisher’s role over any given journalistic work unclear in each copyright system. A publisher can control an organized product – a newspaper or other press product – and a journalist can have rights to a separable contribution. No indication of employment status or ownership of the publication is intended to answer the question of whether or not later articles may be detached, translated, adapted, syndicated, put into a stand-alone database, or supplied to a third party. This article tackles the transnational issue by examining the copyright systems governing authors’ rights from a doctrinal, comparative and case law perspective, the United States collective-work doctrine and an illustrative legislative case study of Uzbekistan. It develops a three-level digital use model subsequent. The six cumulated indicators used for the model are continuity of editorial purpose, preservation of context, degree of alteration, identity of the outlet, economic autonomy and involvement of third parties, defining reuse as functional continuity and modified reuse or autonomous commercial exploitation. Functional continuity can be part of the originally authorized publication purpose; modified reuse must be granted by a specific act of authorization and must respect the personal rights of the journalist; autonomous commercial exploitation must be based on a different contract with the journalist and entitle the journalist to a remuneration. The article also proposes model press-publishing legislation and author–publisher agreements that are applicable in all jurisdictions. The model provides a legally testable distinction between the exploitation of a press publication and the exploitation of an incorporated journalistic work.
