Editorial offices and editors in media organizations are responsible for preparing journalistic works for publication while ensuring their accurate representation. Editing should be carried out with due regard to authorship rights and factual accuracy. A journalistic work is the result of an institutional process in which the competence of the reporter shares authorial responsibility with the editorial office for the accuracy of facts, legality and style, and for its timely appearance. The failure to make a principled distinction between those interests often results in treating ordinary editing, alteration of meaning, and secondary commercial use equally under the law. In this article, we will be looking at how copyright should be divided between journalists and media organizations, with a focus on proper attribution, anonymity, integrity, service works, freelance contributions and digital republication. Research has been carried out on the doctrinal, comparative, functional and case-law analysis of legislation and judicial practices of Uzbekistan and the USA (with regard to international standards of copyright). The study finds that neither complete author control nor complete editorial ownership is a proper model. It proposes a three-tiered rights allocation and one test for an editorial-purpose test that draws a line between permissible technical editing and changes requiring the author’s consent. It also distinguishes between first publication and economically independent reuse in databases and other uses such as paid archives, translations, syndication and third-party platforms.
