The Evolution of Criminal Liability for Official Forgery: From Islamic Law to the Modern Legislation of Uzbekistan

Annotatsiya

The article retraces the historical development of criminal liability for official forgery in the territory of present-day Uzbekistan. Three legal layers are examined consecutively: the Islamic law of Mawarannahr, the criminal legislation of the Russian Empire applied in the Turkestan Governorate-General after 1867, and the Soviet codifications of 1922 and 1926. The author shows how the relevant norm gradually separated from the broader concept of forgery and acquired its modern features, including a special subject, the official document as the object of the crime, and the requirement of substantial harm. Conclusions are drawn regarding the influence of each historical stage on Article 209 of the current Criminal Code of the Republic of Uzbekistan.
