Drawing on foreign experience, this article provides a comparative legal analysis of the protection of bona fide possessors across five broadly defined legal families: (1) Germanic (Germany, Switzerland, Austria); (2) Romanistic (France, Italy); (3) Slavic-Eurasian (Russia and post-Soviet CIS countries); (4) Anglo-American (the United Kingdom and the United States); and (5) Asian (Japan and China). Based on the functional-comparative method of Zweigert and Kötz, the author identifies four key parameters distinguishing these legal systems: (a) the standard of knowledge; (b) the burden of proof; (c) the relationship between vindication and restitution; and (d) the application of the principle of public reliability of registers. Each parameter is supported by specific examples from judicial practice. Based on the analysis, an “optimal model” is proposed for reforming the rights of bona fide possessors under the civil law of the Republic of Uzbekistan. By comparing the principles of the priority of owners’ interests, the stability of civil transactions, and trust in the state register, the article presents a reasoned position.
