The development of a new Criminal Code requires a prior choice of a criminal law model. Before drafting specific criminal offences, it is necessary to determine the grounds of criminal liability, the limits of criminalization, the purposes of punishment, and the relationship between public interests and the constitutional rights of individuals. Drawing on criminal law reforms in Finland, Germany, Estonia, Spain, and Norway, the article examines the significance of these decisions for the internal coherence of the future Code. The article proposes that Uzbekistan's criminal law reform should begin with the development of a system of binding criminal policy decisions that will determine the content of the future Concept for a new Criminal Code. Its proposed foundation is a model of criminal law constrained by constitutional requirements of culpability, necessity, and proportionality. Under this model, criminal law protects the most significant legally protected interests while also defining the limits of state coercion.
