Annotatsiya

The article analyses the constitutional and legal aspects of protecting privacy and personal data in the context of artificial intelligence. The aim is to compare foreign constitutional models and, on that basis, to identify directions for developing Article 31 of the Constitution of the Republic of Uzbekistan. Comparative legal, formal legal and systemic methods were used. The concept of the “digital person” is defined as an integrated set of data relating to an individual, identifiers, activity traces and algorithmic inferences. Drawing on the experience of Germany, Portugal, Brazil, South Africa and the United States, the article identifies three models of digital privacy protection: the interpretive model, the specific-provision model and the fundamental-right model. It shows that the 2023 judgment of the German Federal Constitutional Court, the US Supreme Court’s decision in Carpenter and the CJEU’s SCHUFA judgment treat algorithmic inferences as an independent object of legal assessment. The article argues that the right to have inaccurate data corrected under Article 31 of the Constitution of Uzbekistan extends to algorithmic inferences. It proposes constitutional impact assessment, ultimate human responsibility, a right to correct algorithmic profiles, a right to challenge automated decisions, the privacy by design principle, a prohibition on inferring special categories of data, and independent audit.
