This article examines theoretical and practical issues concerning the protection of exclusive trademark rights through economic court proceedings. It analyzes the legal nature of disputes arising from the unauthorized use of trademarks, the introduction of confusingly similar marks into commercial circulation, and infringements affecting the rights and legitimate interests of trademark owners. Particular attention is paid to challenges associated with the assessment of evidence, the establishment of trademark infringement, the determination of similarity between marks, and the application of legal remedies in disputes adjudicated by economic courts. The article also proposes theoretically grounded and practically oriented measures to improve the mechanisms for judicial protection of trademark rights.
