Annotatsiya

This article analyzes the theoretical and legal foundations for the use of referential and blanket norms in codified legislation, drawing on foreign scholarly research and international instruments. The author identifies the positive functions of referential norms—ensuring economy of legislative text, preserving the integrity of the legal system, and providing flexibility in rapidly changing fields—as well as their adverse consequences, including legal uncertainty, increasing complexity of the body of legislation, risks to the principle of legality, and the shifting of governmental powers. Drawing on the Joint Practical Guide of the European Union on the drafting of legislation, the advisory opinion of the European Court of Human Rights of 29 May 2020, the recommendations of the Administrative Conference of the United States, and studies by D. Katz, M. Bommarito, J. Ruhl, C. Coupette, E. Bremer, J. Maxwell, A. Antón, G. Maggs, and H. Xanthaki, the article proposes legal and legislative-drafting criteria for the use of referential norms in the preparation of codes in the Republic of Uzbekistan.
