The article examines one of the least studied aspects of legislative codification: the reasoned choice of the appropriate level of legal regulation—statutory or subordinate—at the stage of bill drafting. The author summarizes the doctrinal foundations for delimiting the subject matter of statutes and subordinate legislation, including the German Wesentlichkeitstheorie, the French constitutional concept of the domaine de la loi, and the Venice Commission’s criteria on delegated rule-making, and compares them with Uzbekistan’s law-making practice. The vertical dimension of codification is substantiated as an independent theoretical category. The study identifies the absence of a mandatory assessment of the appropriate regulatory level in national legislation and formulates proposals for introducing such an assessment.
