The article examines the theoretical and legal status of regulatory impact assessment (RIA) within the process of legislative codification. The author contrasts the traditional view of codification as the highest form of systematization with the contemporary doctrine of “better regulation” and argues that, under conditions of decodification, the intuitive-doctrinal method of drafting codes has exhausted its potential. The views of J.-L. Bergel, G. Weiss, N. Irti, R. Sacco, W. Voermans, P. Popelier, C. Radaelli, L. Wintgens, M. Mousmouti, Yu. Tikhomirov, and other scholars are analyzed. Drawing on the experience of France, Germany, Switzerland, the United Kingdom, the European Union, the OECD, and transition countries, the article identifies the functions performed by RIA at three stages of codification: preliminary diagnosis of the regulatory stock (ex ante), preparation of the draft code, and monitoring of the code in force (ex post). A separate section analyzes a model of retrospective assessment conducted five years after a law enters into force, initiated by the responsible state bodies and committees of the chambers of parliament, with the involvement of civil society institutions. The article concludes that RIA is not an external or optional supplement to codification but an internal methodological prerequisite for its evidentiary soundness, proportionality, and legal certainty.
