This article examines the historical development and key characteristics of modern codification in Continental Europe, focusing on the French, Austrian, German, and Swiss codes. It analyzes the essential elements of codification—authority, completeness, systematic structure, reform, national legal unity, and simplicity—and explores their role in shaping the nature and application of codified law. The study highlights the tension between comprehensiveness and simplicity, the influence of natural law theorists and Enlightenment thought, and the evolution from absolutist to liberal constitutional legal systems. By using the concept of Max Weber’s “ideal type,” the article demonstrates how individual historical codes contribute to an abstract understanding of codification, emphasizing its dynamic and evolving character. This analysis provides insights into the interplay between historical context, legal theory, and legislative practice, illustrating the continuing relevance of codification in modern legal systems.
