Specific features of evidence in inheritance disputes

This article analyzes the specific aspects of the evidentiary process in the judicial review of disputes arising from inheritance legal relations. The subject of proof in inheritance cases is directly related to the nature of the dispute, with key circumstances—such as the opening of the succession, the circle of heirs, the composition of the estate, facts of acceptance of the inheritance, the existence of a will, and the issue of unworthy heirs—constituting the principal objects of proof. The article also examines the formation of the evidentiary base, the probative value of notarial documents, the court’s authority to request evidence, and the practice of ordering expert examinations in inheritance cases. In addition, problems related to the evaluation of evidence in establishing facts of dependency and kinship are analyzed with reference to judicial practice.
