Criminal-legal transformation of combating cybercrime in the Republic of Uzbekistan: the concept of adaptive punishment and digital law enforcement

Annotatsiya

This research analyzes the current state of and reform directions for the criminal law regulation of cybercrimes in the Republic of Uzbekistan. In the context of the rapid digitalization of the economy and public administration, the author substantiates the need to revise the provisions of Chapter XX-1 of the Criminal Code (Articles 278¹–278⁷) in order to enhance the effectiveness of criminal liability and the preventive potential of punishment. The study proposes the concept of “adaptive criminal law,” focused on technological neutrality, fairness, and the protection of national cybersecurity. The proposed measures aim to form a new legal paradigm—a digital legal order—in which punishment serves as an instrument for ensuring the stability and security of society.
