The article provides a comprehensive analysis of current problems in international commercial arbitration as a key mechanism for resolving cross-border disputes. The research examines issues of the arbitrability of disputes, the recognition and enforcement of arbitral awards, the determination of applicable law, multi-party proceedings, interim measures, confidentiality, as well as problems related to the cost and duration of arbitration procedures. The author analyzes modern trends in the development of international arbitration, identifies systemic deficiencies in existing legal regulation, and formulates specific proposals for improving national legislation and international legal instruments. Particular attention is paid to the contradictory practice of applying the 1958 New York Convention, issues related to multi-party arbitration proceedings, and the balance between confidentiality and transparency. The study is based on an analysis of international treaties, model laws, institutional rules, and the case law of various jurisdictions.
