This article provides an in-depth analysis of the essence and significance of the institution of an investigator’s procedural independence, its role in criminal proceedings, and its place in current legislation. The limits of independence established by law, as well as the factors influencing an investigator’s freedom to make decisions under conditions of prosecutorial and judicial supervision, are also highlighted. The article analyzes the scholarly views of domestic and foreign procedural scholars on investigator independence, outlining its key elements, including the right to independently determine the direction of an investigation, make procedural decisions, evaluate evidence based on inner conviction, and appeal a prosecutor’s instructions. The role of the concepts of inner conviction and conscience in investigative activity is also legally and theoretically substantiated. At the same time, the article emphasizes that ensuring the procedural independence of the investigator is an essential condition for upholding legality, justice, and human rights within the system of state governance and law enforcement agencies.
