This article comprehensively examines the procedural functions and duties of an investigator in criminal proceedings. Along with defining the investigator’s main role in prosecution activities, the study scientifically substantiates the investigator’s role in ensuring human rights and freedoms, as well as their duties in the fair and lawful resolution of criminal cases. The article provides a comparative analysis of the views of domestic and foreign procedural scholars, identifies conceptual problems in the norms of the current Criminal Procedure Code, and proposes specific measures for their improvement. In particular, the article scientifically substantiates that, while exercising the prosecution function, the investigator must simultaneously identify circumstances that prove a person’s innocence, and emphasizes the importance of ensuring that the functions of prosecution, defense, and adjudication are not conflated in the investigator’s activities. The article proposes amendments and additions to Articles 2 and 25 of the Criminal Procedure Code aimed at further strengthening the presumption of innocence, the obligation to prove, and procedural guarantees in criminal proceedings. The research results have practical significance in enhancing the effectiveness of criminal proceedings, ensuring human rights, and improving the activities of prosecution and investigation bodies by clearly and legally defining the procedural status and functions of an investigator .
