Annotatsiya

The article analyzes the investigator’s procedural powers in collecting digital (electronic) evidence and the issues related to their improvement. Assessing the sequence of reforms implemented in Uzbekistan between 2021 and 2026 (Decree No. UP-6256, Resolution No. PP-381, Law No. ZRU-1003, Resolution No. 14 of the Plenum of the Supreme Court dated 23 June 2025, Decree No. UP-204 approving the “Digital Prosecutor’s Office – 2030” Strategy, and Law No. ZRU-1125), the author identifies six procedural gaps: the incompleteness of the terminological framework; a conflict between the rule governing conduct (Article 136 of the CPC) and the sanctioning rule (Article 95¹ of the CPC) concerning the participation of a specialist; the inadequacy of the existing procedural form for digital objects; the absence of a mechanism for ensuring integrity; the absence of an expedited preservation mechanism for “volatile” data; and the absence of an integrity requirement for digital evidence obtained through operational-search activities. Drawing on international standards (ISO/IEC 27037, 27041, and 27042), the UN Convention against Cybercrime signed by Uzbekistan, the Budapest Convention, and the German Code of Criminal Procedure (StPO), the author proposes specific normative solutions, each formulated either as draft legislative wording or as a proposed structure of the relevant legal provision (de lege ferenda).
