Legal Regulation of Copyright in Social Networks: International Experience and Prospects for Adaptation in Uzbekistan

The article examines legal models for regulating copyright in the digital environment using the example of foreign countries, primarily those of the European Union, with a focus on the specific features of their application in the context of social network operations. The main focus of the study is to identify the potential for adapting these approaches to the national legal system of the Republic of Uzbekistan. It is asserted that the current copyright legislation in Uzbekistan does not ensure an adequate level of protection for authors' rights in the context of digitalization and the dissemination of user-generated content on social networks. This is due to the absence of legal mechanisms providing for the liability of online platforms, procedures for preliminary content filtering, and prompt response to infringements. The study is based on a comparative legal analysis of the approaches of Germany, France, and Estonia, including an analysis of the legislation of the Republic of Uzbekistan, as well as elements of a systems-based approach to assessing legal implementation. It has been established that Uzbekistan’s regulatory framework in this area does not contain provisions analogous to the mechanisms of notice-and-takedown, platform liability, and extended collective rights management used in several EU countries. At the same time, the legal models of Germany and France provide a balanced distribution of responsibilities among authors, platforms, and users, while Estonia demonstrates the successful implementation of digital tools for collective licensing and monitoring. Based on the conducted analysis, proposals have been formulated for adapting certain provisions of EU Directive 2019/790, introducing a legal regime of online platform liability, establishing a digital infrastructure for copyright control, and harmonizing national legislation with international standards.
