This article analyzes the inadequacy, under current conditions, of the cultivated-area criterion used to determine circumstances aggravating liability for the offense of cultivating prohibited crops under Article 270 of the Criminal Code of the Republic of Uzbekistan. The author examines the inconsistency of this criterion with the requirements of Resolution No. 330 of the Cabinet of Ministers and the Resolution of the Plenum of the Supreme Court and, based on a comparative study of the experience of the United States, the United Kingdom, and the Netherlands, develops proposals and recommendations for improving the investigation of such crimes.
