The establishment of exclusive rights in appellations of origin of goods within the intellectual property law system gives rise to significant conceptual contradictions in classical civil law theory. The purpose of this study is to analyze the legal nature of the right to an appellation of origin of goods in national jurisprudence through the lens of the theory of exclusive rights and to develop substantive legal solutions aimed at eliminating doctrinal anomalies in the current legislation. Using formal-legal, comparative-legal, systemic-structural, and legal hermeneutic methods, the study conducts a comparative analysis of international treaties in the field of intellectual property, European Union legislation, and national civil law provisions. The findings demonstrate that, although current regulatory legal acts recognize an appellation of origin of goods as a traditional object of exclusive rights, the exercise of such essential elements of an exclusive right as disposition (transfer to another person or licensing) and the possession of an individual monopoly is prohibited by law. The existence of equally extensive exclusive rights held by an unlimited number of independent persons in respect of the same object constitutes a legal anomaly in traditional jurisprudence. A practical solution would be to clearly define this object in the Civil Code as a distinct form of intellectual property subject to a collective or sui generis (special) legal regime and to definitively separate it from the legal regime governing trademarks. This approach would eliminate legal uncertainty in the circulation of intellectual property assets and fully harmonize national legislation with international approaches to the legal nature of territorial brands.
