The article examines one of the most persistent problems in international criminal law and international humanitarian law: the lack of operational criteria for distinguishing torture from other forms of cruel, inhuman, or degrading treatment in the context of armed conflict. The author proposes a three-tier model of legal qualification in which the intensity of suffering performs a threshold function, the purposive element serves a distinguishing function, and the victim’s helplessness acts as a contextual corroborating factor. The article also formulates proposals for eliminating the identified asymmetry at the international level and for improving Articles 152 and 235 of the Criminal Code of the Republic of Uzbekistan.
