Torture as a Crime against Humanity under International Law: Constituent Elements, Practice, and Implementation Challenges

Annotatsiya

This article examines torture as an independent crime against humanity within the system of international criminal law. The study is based on an analysis of treaty sources, the case law of international criminal tribunals, and scholarly approaches to understanding the absolute prohibition of torture. Particular attention is paid to the relationship between torture and other forms of cruel, inhuman or degrading treatment, as well as to the evolution of its legal understanding: from a prohibition under international humanitarian law to a norm of jus cogens. The article separately analyzes the conditions for qualifying torture under Article 7 of the Rome Statute of the International Criminal Court, including the context of a widespread or systematic attack directed against a civilian population. Based on ICTY case law, the article identifies the main criteria by which international judicial practice has established torture as one of the most serious international crimes. In conclusion, the article substantiates the need for more consistent implementation of international standards of criminal responsibility for torture into national legislation.
