Annotatsiya

This article analyzes the specific features of criminal law protection afforded to persons in a helpless state who have become victims of crime under the legislation of foreign countries. The legislation of Germany, France, and the United Kingdom, as well as European Union mechanisms for protecting victims’ rights, is examined. The study establishes that, in foreign legal practice, helplessness is assessed with regard to a person’s age, illness, disability, mental or physical condition, and social or economic dependence and, in certain cases, may serve as a basis for the legal qualification of an offense or for imposing a more severe punishment. The article also demonstrates that the victim’s helpless state is relevant to the application of special protective measures in criminal proceedings.
