The Evolution of Criminal Legislation in Uzbekistan: From the 1926 Criminal Code to Modern Law

Annotatsiya

The article examines the evolution of criminal legislation in Uzbekistan in the context of the centenary of the adoption of the 1926 Criminal Code of the Uzbek SSR. It considers the historical and legal significance of Uzbekistan’s first codified criminal law act as a legal monument that laid the foundation for the development of the national criminal law system. The authors analyze the structure of the 1926 Criminal Code, including its General and Special Parts, and the regulation of state, military, economic, property-related, local customary, and water-related crimes. Particular attention is paid to the continuity between certain institutions of the 1926 Code and the current 1994 Criminal Code of the Republic of Uzbekistan, including the concept of crime, forms of guilt, complicity, insanity, necessary defense, extreme necessity, limitation periods, criminal record, suspended sentencing, and parole. At the same time, the article reveals the fundamental doctrinal differences between the Soviet statist model of criminal law and the modern liberal-humanistic paradigm of independent Uzbekistan. The authors conclude that the 1926 Criminal Code is an ambivalent historical and legal monument: on the one hand, it demonstrates a high level of systematization for its time; on the other, it reflects the class-repressive nature of early Soviet criminal law.
