The article examines the problems of legislative construction of criminal law sanctions using Article 260 of the Criminal Code of the Republic of Uzbekistan as an example. The authors analyze amendments introduced to the sanctions of this provision by the laws of the Republic of Uzbekistan adopted in 1999 and 2015, with particular attention to the exclusion of minimum terms of imprisonment from the sanctions of Parts Two and Three of Article 260. The article substantiates the conclusion that such a legislative approach contradicts the provisions of the General Part of the Criminal Code concerning the classification of crimes, as established in Article 15, since it creates uncertainty in determining the proper category of the relevant criminal acts. It is emphasized that excessively broad and “amorphous” sanctions expand the scope of judicial discretion, complicate uniform law enforcement, and may serve as a corruption-generating factor. The authors argue that, when constructing relatively determinate sanctions for less serious, serious, and especially serious crimes, the legislator must establish both the minimum and maximum limits of imprisonment. The article concludes that criminal law sanctions must be brought into strict conformity with the degree and nature of the public danger of crimes.
