This article analyzes the institution of necessary defense as a circumstance excluding the criminality of an act. It examines the constitutional and criminal law foundations of necessary defense, the elements of unlawful assault and defensive action, as well as the problems of exceeding the limits of necessary defense and imaginary defense. The article also substantiates the importance of German legal experience and the need to develop unified criteria in national law enforcement practice.
