Annotatsiya

This article provides an in-depth analysis of the social danger of the crime of violating occupational health and safety rules under Article 257 of the Criminal Code of the Republic of Uzbekistan, its specific features, and the key criteria and theoretical problems of correctly qualifying this act in judicial and investigative practice. The research examines the specific aspects of the object, objective side, subject, and subjective side of the crime, highlighting the most common practical errors, particularly the issues of distinguishing negligence from indirect intent. Furthermore, statistics on occupational injuries and fatalities across the regions of Uzbekistan for 2024–2025, including infographic data, are empirically analyzed, demonstrating the scale of the problem. The article reveals legal gaps in ensuring labor protection and determining liability in the context of outsourcing, remote work, home-based labor, and the gig economy in the current era of digitalization. In addition, scientifically grounded practical proposals and conclusions are developed to improve the effectiveness of occupational safety by introducing the institution of criminal liability of legal entities, legally recognizing the use of digital evidence, and implementing advanced international experience in national legislation.
