This article examines the essence of the concept of recidivism, or the reoccurrence of crime, as a form of multiple offenses and explains the substance of its defining characteristics. Specifically, based on an analysis of criminal law, the author highlights the legal significance of the institution of recidivism for the classification of crimes, sentencing, mitigation of punishment, and full or partial release from punishment. Through scholarly debate with other authors, the fundamental features of criminal recidivism are revealed. By distinguishing between the quantitative and qualitative attributes of recidivism, including the commission of two or more criminal acts, the presence of intentional guilt, and the individual’s prior criminal record, the article explores their internal content. Furthermore, the types of recidivism provided for by the current criminal legislation of the Republic of Uzbekistan are presented. Based on an analysis of these legal norms, the author notes the peculiarities of their structure and the specifics of their application. The study concludes by proposing that the designations of “dangerous” and “especially dangerous” recidivism as aggravating factors be excluded from the provisions of the Special Part of the Criminal Code. Instead, it is argued that the status of recidivism should be considered exclusively as an attribute related to the offender during sentencing and the application of legal institutions for release from liability and punishment.
