Annotatsiya

The article examines the participation of third parties in economic proceedings as an important procedural mechanism ensuring the comprehensive, objective, and lawful consideration of an economic dispute. It reveals the legal nature of third parties, their place within the system of persons participating in a case, and the significance of their participation in ensuring legality, adversarial proceedings, equality of the parties, procedural economy, and legal certainty in economic proceedings. Particular attention is paid to distinguishing third parties who assert independent claims regarding the subject matter of the dispute from third parties who do not assert such claims, taking into account differences in the nature of their legal interest, the scope of their procedural rights, and the possible impact of a judicial act on their rights and obligations. The article analyzes the provisions of the Economic Procedural Code of the Republic of Uzbekistan governing the participation of third parties, as well as the importance of the preparatory stage of court proceedings for the timely identification of interested business entities. It is concluded that the institution of third parties in economic proceedings performs not an auxiliary but a guarantee function, since it enables the economic court to consider a dispute with due regard to the interests of all entities whose rights and obligations may be affected by a judicial act.
