This article examines the growing prevalence of phishing and online fraud in the modern digital environment, as well as their legal nature and issues of criminal-law qualification. Based on statistical data, the increasing trend of such crimes in the Republic of Uzbekistan is highlighted. A comparative legal analysis of the practices of Russia, the United States, China, France, Germany, Japan, and Italy is conducted, revealing different approaches to the qualification of phishing offenses. Particular attention is paid to the concept of “defect of will”, the role of electronic evidence, and the effectiveness of preventive measures. The article also provides scholarly and practical recommendations for improving national legislation and judicial practice.
