This article presents a systematic analysis of the factors affecting the effectiveness of the preliminary hearing institution in the criminal procedure of the Republic of Uzbekistan. The author examines the dispositive nature of Article 4053 of the Criminal Procedure Code, legislative gaps regarding the time limits for filing motions by the parties, insufficient normative regulation of prosecutorial participation, and problems related to the qualifications of prosecutorial personnel. Based on the scholarly conclusions of previous research, specific proposals for improving the legislation have been developed. In particular, the article substantiates the necessity of transforming the conduct of preliminary hearings into an imperative norm, restricting the participation of prosecutorial trainees in supporting state prosecution, and relieving prosecutors participating in court proceedings of additional workloads.
