Annotatsiya

This article examines the theoretical and practical aspects of the procedural legal status of a minor in criminal proceedings. The author critically analyzes the formal-normative and paternalistic approaches, identifying their limitations in ensuring the effective protection of children’s rights. The functional concept of limited procedural autonomy is substantiated, emphasizing the active participation of minors in criminal proceedings with due regard to their age and psychological development. Based on international standards, national legislation, and contemporary legal doctrine, proposals are formulated to strengthen procedural guarantees and ensure the best interests of the child within a child-friendly justice framework.
