Annotatsiya

This article examines the legal nature of parallel import in the context of trademark protection through the doctrine of the exhaustion of exclusive rights. It analyzes national, regional, and international exhaustion regimes, as well as comparative approaches in the European Union, the United States, Russia, and the Republic of Uzbekistan. Particular attention is given to enforcement challenges in Uzbekistan, including the lack of a clear territorial criterion for exhaustion and the absence of a “legitimate reasons” mechanism as a limitation on further commercialization. The study substantiates the need for legislative clarification and the introduction of additional safeguards to ensure a balanced protection of trademark owners, consumers, and competition.
