The article provides a comparative analysis of international commercial arbitration and international investment arbitration as the principal mechanisms for resolving cross-border disputes. The relevance of the study stems from the need to clearly distinguish their procedural regimes for the effective protection of investors' rights. The research is based on a comparative legal and dogmatic analysis of international conventions (the 1965 Washington Convention, the 1958 New York Convention), arbitration practice (illustrated by cases such as Occidental v. Ecuador and Al-Qarqani v. Chevron), and legal doctrine. The application of the functional method allowed for an assessment of the practical consequences of choosing a specific arbitration instrument. The study establishes a fundamental difference in the nature of disputes: commercial arbitration deals with private law conflicts between equal parties, while investment arbitration focuses on public law disputes involving a sovereign state (jure imperii). It is revealed that the latter serves as a forum for monitoring compliance with international investment protection standards. Despite the advantage of the global enforceability of awards under the New York Convention, investment arbitration faces systemic challenges. These include the doctrine of sovereign immunity, limitations on the arbitrability of public law disputes within national jurisdictions (particularly under the legislation of Uzbekistan), and the risks of challenging the arbitration agreement. It is concluded that an investor requires a meticulous procedural strategy at the investment structuring stage, involving the selection of an optimal dispute resolution mechanism that considers the subject matter of the dispute, jurisdictional specifics, and the prospects for enforcement.
