This article analyzes the legal and practical role of private penitentiary institutions in South Korea as non-profit legal entities. The focus is on the Somang Penitentiary Institution, the first and only non-profit private correctional facility in Asia, which was established in 2010 by the Agape non-profit foundation and operates under state supervision and financial support. The article highlights the advantages of the non-profit model, including rehabilitation, inmate satisfaction, the reduction of recidivism rates, and cost savings for the government.
