This article focuses on the objective aspects of the crime of exposing others to the risk of HIV infection or transmitting HIV, as stipulated in parts 4 and 5 of Article 113 of the Criminal Code of the Republic of Uzbekistan. The author, having conducted a scientific analysis of the term "distribution" used in the title of this article from both medical and lexicographical perspectives, argues for the necessity of replacing "distribution" with "exposing to the risk of infection or transmitting". Furthermore, considering that part 4 of this article does not differentiate between the varying degrees of social danger posed by "exposing to the risk of infection" and "transmitting", and that the punishments imposed for this crime lead to a violation of the principle of justice, the author justifies the need to establish separate provisions for the responsibility of "exposing to the risk of HIV infection" and "transmitting HIV".
