Characteristics of the subjective element in the crime of HIV/AIDS transmission

Annotatsiya

This article examines the subjective aspect of the crime of endangering or transmitting HIV, as stipulated in part 4 of Article 113 of the Criminal Code of the Republic of Uzbekistan. The author analyzes the subjective significance of HIV transmission to two or more persons and argues for the necessity of supplementing the article with a new clause "in relation to two or more persons." Furthermore, considering that Article 113 of the Criminal Code addresses intentional commission of the crime, and that the transmission of HIV/AIDS to another person due to failure to perform or improper performance of professional duties is always committed through negligence, the author justifies transferring the fifth part of Article 113 of the Criminal Code to Article 116.
