The article provides a comprehensive analysis of legal challenges in regulating small modular reactors (SMR). SMRs are nuclear installations with capacity up to 300 MW featuring modular design, passive safety systems, and promising potential for decentralized energy supply. According to IAEA data, over 80 SMR projects are under development worldwide. The study conducts a comparative analysis of national regulatory models in the USA, Canada, UK, Russia, China, and Argentina – examining project-oriented, process-flexible, integration, and parallel development approaches. Key legal challenges include: licensing and certification of modular installations, distribution of civil liability, cross-border regulation of floating SMRs, adaptation of nuclear safety requirements to new technologies, ensuring public participation, and integration into emergency response systems. Existing international treaties such as the Vienna and Paris Conventions, developed for traditional stationary NPPs, create legal gaps when applied to SMRs. The article presents practical recommendations for harmonizing international standards, adopting a special protocol, establishing a mechanism for mutual recognition of licenses, developing an IAEA model law, integrating maritime and nuclear law, and developing specialist training programs.
