This article analyzes the necessity of creating effective mechanisms for safeguarding human rights and freedoms during the pre-trial stage, the procedural mechanism of judicial oversight, and the problems associated with gaps in legal regulation. Additionally, the need for a system of procedural guarantees aimed at ensuring the legality and validity of investigative actions, the proportionality of restrictions on individual rights, and the court's activities in this direction are discussed.
