This article is devoted to a comprehensive analysis of the institution of the situation of the surviving spouse and his rights to jointly acquired property. This work is devoted to the analysis of legislative gaps in the protection of the rights of the surviving spouse, and also raises the issues of state social support of widows and widowers. The work examines the law enforcement practice of issuing a certificate of right to property to the surviving spouse.
