The article analyzes problem loans, or non-performing loans (NPLs), not merely as a financial issue related to the quality of bank assets in the credit sector, but as a complex legal and economic phenomenon connected with legality, economic security, state financial interests, and citizens’ property rights. The study examines the causes of the formation of problem loans in relation to information asymmetry, credit rationing, delegated monitoring, cyclical easing of credit policy, bank management efficiency, macrofinancial vulnerabilities, and the quality of supervisory institutions. Without rejecting the international 90-day criterion for non-performing loans, the author substantiates the introduction of a 60-day early legal diagnostic mechanism for prosecutorial supervision. The article proves that the role of prosecution authorities is not to duplicate banking supervision, but to ensure legality in credit relations, detect violations at an early stage, protect the interests of the state and citizens, and coordinate the activities of competent authorities.
